1) Contract conclusion
Registration can be effected in written (letter, fax, email) or verbal form or personally. As soon as we confirm the booking in written form, it becomes binding. In your own interest, we ask you to book the canyoning tour as soon as possible.
2) Scope of services
Please find the scope of services in your booking confirmation. In case of non-existance of a written confirmation, the scope of services mentioned in the current brochure/homepage is to be considered The effective price can as well be taken from said brochure.
3) Cancellation by the customer
A cancellation of a booked tour is always possible. In order to avoid misunderstandings, we ask you to cancel the canyoning tour in written form.
In case of cancellation, the upcoming percentage of arrangement costs will be charged to the contracting party:
More than 30 days before the canyoning tour: 10 %
29 – 22 days before the canyoning tour 15 %
21 – 15 days before the canyoning tour 25 %
14 – 7 days before the canyoning tour 40 %
6 – 3 days before the canyoning tour 60 %
2 or 1 day before the canyoning tour 80 %
Day of the canyoning tour 100 %
4) Substitute person
Should the contracting party be unable to attend the canyoning tour, it is possible to suggest a replacement person. Said person can replace the contracting party under certain circumstances (same conditions of participation).
5) Cancellation by the organizer
The organizer reserves the right to withdraw from the contract, should the tour be made impossible by the participant’s behaviour, omissions or other actions. Should the participant be unable to attend a tour due to a misjudgement of his capabilities, the organizer as well reserves the right to withdraw from the contract.
Moreover, a minimum number of participants are required for the canyoning tours. If this number is not met, we equally withdraw from the contract up to one week before the canyoning tour.
6) Non-utilised services
If a participant does not utilise individual services for whichever reason, the invoice price is in principal not refunded. It is at our discretion to provide vouchers for non-utilised services in hardship cases such as illnesses, accidents or the like.

7) Change of bookings
After a binding booking, we give our utmost effort to change your booking wherever possible if you wish. Occurring extra costs will be at the participant´s charge.
8) Terms of payment
After receiving our invoice/booking confirmation, we ask you to pay the due amount onto our account within 14 days by the day of the canyoning tour. It is possible to pay cash or via bank transfer.

10) Reasons for excluding participants
Only participants who are in good general health condition and do not have any physical or mental handicap is able to attend a canyoning tour.
Furthermore, no participant under the influence of alcohol, drugs, psychiatric drugs or any similar substances will take part in the tour.
The instructions of the organizer, guides and assistants are to be strictly followed. If the instructions are disregarded, the organizer reserves the right to exclude the participant who will not have any right to be refunded.
All tours are chosen and planned carefully and professionally. However, there might be some objective and subjective risks. The participants are not insured by the organizer. Therefore, we recommend ensuring that you have sufficient health and accident insurance.
If a canyoning tour cannot be carried out due to Acts of God, safety concerns or the like, the organizer reserves the right to cancel the tour on short notice. In that case the organizer tries to offer the participant a service substitute e. g. on a different day. Should that not be possible or should the participant refuse the substitute, the participant has no right for a refund.
The organizer renders the services as stated in the contract as a prudent businessman. Please note that participation takes place at the participant´s own risk; the organizer is not liable for intent or gross negligence.
The booking fee includes only guidance and briefing. The organizer limits its liability irrespective of the legal basis onto the triple of the booking fee. We are not liable for defaults in connection with services where we act as intermediary. In that case the conditions of participation of the respective organizer are valid.
14) Duty to collaborate
In case of impairment of performance, the participant is obliged to collaborate considering the legal requirements to avoid or minimise possible damage.
The participant is moreover obliged to immediately communicate his or her complaints to the staff who will then try to answer the complaint. Should the participant not communicate potential damages, the organizer is not liable.
15) Nullity of individual services
The nullity of individual services does not affect the rest of the contract. The organizer is entitled to replace this part of the contract by a substitution regulation.
16) Exclusion of entitlements and limitation of claim
All entitlements with regard to the contract are to be argued within one month after the predicted completion of the canyoning tour.
After the termination of this grace period, the participant can argue entitlements when he or she was impeded to observe the grace period in the absence of fault. All entitlements in regard of the contract become time-barred after six months.
Limitation of claim starts with the predicted completion date of the canyoning tour. Should you have argued such entitlements, the limitation of claim stays a legal action until we reject the entitlements in written form.
17) Photographs and movies
During the canyoning tour, our guides carry a camera along and take souvenir photos of the participants (after face-to-face consent). These will partially be published on the homepage (www.aquathrill.at). We assertively point out that the right of the taken pictures belongs to the owner/user of the camera. The photos are used for advertising and are not sold.
18) Applicable Law and area of jurisdiction
Between the client and the organizer the law of the German republic is exclusively applicable. Donaueschingen is the legal domicile.
